正当防卫案件'防卫性'的实务剖析

摘要

On justifiable defense "defensive" condition specific issue has been the legal theory and judicial practice the focus of debate in the field.This article is tightly bound to the present on the system of criminal law of legitimate defence in the Criminal Code provisions and a number of experts and scholars of the illuminating,especially the problem of combining six cases involving self-defense case conditions to legitimate the practice analysis and argumentation,and legal and legislative,judicial,in particular judicial ap-plication perspective of sublimation.%正当防卫中"防卫性"成立条件的具体认定问题一直是法学理论界和司法实务领域争论不休的焦点.本文结合我国现行《刑法》中关于正当防卫刑法制度的规定和多家专家学者的精辟阐述,尤其是紧密结合六起涉及到正当防卫问题的实际案例对正当防卫的成立条件进行实务剖析和论证,并力图在法理和立法、司法特别是司法适用角度加以升华.
