拒不支付劳动报酬罪的立法解读及司法适用

摘要

拒不支付劳动报酬罪作为《刑法修正案（八）》的新增罪名，将对抑止恶意欠薪行为、稳定社会公共秩序起到重要作用。然而，本罪作为一项新罪名，在司法适用过程中需要就劳动报酬、主体范围、客观行为、法律责任等问题的认定进行探讨研究，从而为司法实践提供指导参考。%The crime of refusing to pay labors is newly added to the Amendment to Criminal Law （NO.8）, which will play an important role in inhibiting intentionally arrears of wages and stabilizing the society. As a newly- added charge, we still need to carry out further research in defining payment of labor, subject of crime, objective criminal behavior and legal obligation in order to provide guidance for judicial practice.
