羁押必要性审查制度，是我国羁押法律控制体系中的一项新举措。作为一项新生制度，其在适用范围及阶段、启动方式、审查主体、内容等方面均存在一定问题。完善羁押必要性审查制度，可以采取以下措施：改进审查工作方式，做到全面审查与重点审查相结合，明确监所检察部门负责审查起诉阶段的案件，强化程序启动的刚性，建立审查程序中的检察员过失豁免制度，补充相关审查内容等等。%T he custody necessary examination system is a new measure of custody system at the Chinese justice system. As a new system, it has some problems in the scope of application and stage, start-up mode, the subject of examination, the content of examination. To improve the custody necessary examination system, the countermeasures to solve the problem are briefly as follows: to improve the means of examination, combining the comprehensive examination with the major examination;to establish the procuratorial supervision department is responsible for the cases in the stage of examination and prosecution; to strengthen the rigidity of starting the procedure; to establish the procurator fault exemption system in the review process;to supplement the relevant examination content.
