社区矫正视野下的重整性羞耻理论

摘要

我国的社区矫正制度正日益完善，但也面临诸多新的问题。其中，社区矫正中出现的烙印性羞耻现象，是社区矫正制度无法回避的，也是司法改革必须解决的问题。因此，有必要从烙印性羞耻的表象入手，分析烙印性羞耻之弊端，阐释重整性羞耻理论对消除烙印性羞耻现象的价值，并将其应用到社区矫正的实践中。%The community correction system in our country is improving day by day, but it is also facing some new problems at the same time. Among them, the phenomenon of stigmatizing shame in community correction is a problem that can not be avoided, it is also the problem of judicial reform must be resolved. This paper starts with the appearance of stigmatizing shame in community correction. On the basis of analyzing the drawbacks of stigmatizing shame, this paper expound the value of reintegrative shame to the elimination of stigmatizing shame. Finally, this paper puts forward the project how to apply the theory of reintegrative shame in the community correction.
