The law is the weapon to govern a country,and good law is a prerequisite for good governance. The statement of Good Law and Good Governance not only highlights the complementary internal relations of law and moral,but also implies the realization approach of basic statecraft"combining Rule of Law with Rule of Virtue",which is the result of traditional Confucian's inheritance and the driving force of social governance getting better and better. In order to realize the organic combine of"Rule of Law and Rule of Virtue",it is necessary to formulate good law that "content reflects public opinion, terms are clear and feasible and legislative process is proper" through the legalization of morality,and we also have to rely on the rule of law ensuring the party's command,limiting the right of governance,empowering independence to judiciary, improving law enforcement of professional ethics"through moralization of law.%法律是治国之重器,良法是善治之前提.良法善治的提出不仅再次彰显了法律与道德共生互补的内在关系,也内嵌了"依法治国与以德治国相结合"这一基本治国方略的实现途径,是传统儒家法治思想的历史传承与社会治理效果不断优化的现实驱动共同作用的结果.实现依法治国和以德治国的有机结合,既要依靠道德法律化制定"内容体现民意、条款清晰可行、立法程序正当"的良法,又要依靠"依法治党的统领保证、依法限权立责的善政保证、依法赋权独立的司法保证、依法提高职业道德能力的执法保证"的法律道德化过程达成善治.
