视频搜索网站深度链接行为的刑法规制

摘要

在网络环境中，视频网站深度链接侵权行为呈现“帮助行为独立化”、“依附行为主动化”、“间接行为直接侵权”趋势，视频网站深度链接侵权行为的危害性比直接上传作品的盗版侵权行为危害性大得多，应该认定这种行为属于《刑法》第217条规定的非法“复制发行”行为，构成侵犯著作权罪。%In the network environment, the deep link infringement acts of video website are presenting several trends, including“the independence of helping behavior”,“the initiative of compliance behavior”and“indirect acts becoming direct infringement”.The deep link infringement acts do more harms than piracy infringement act which upload works directly, so that it should be recognized as illegal“copy issued”acts under article 217 of criminal law, which constitutes the Crime of Infringement of Copyright.
