第三人侵害债权制度研究

摘要

The paper started from the perspective of legal theory, combined with the comparison with foreign laws on the third party’s infringement on creditor’s rights ,and analyzed the attitude to the third party’s infringement on creditor’s rights and the necessity determined on the third party’s infringement on creditor’s rights in national legislation and pratice , called for the rational construction of the system of the third person infringement on creditor's rights.%文章将从法理角度，结合第三人侵害债权制度的域外法比较，通过对我国立法及实践中对第三人侵害债权的态度以及第三人侵害债权制度确立的必要性的分析，呼吁第三人侵害债权制度的合理构建。
