国家公园法律体系的国别比较研究——以美国、加拿大、德国、澳大利亚、新西兰、南非、法国、俄罗斯、韩国、日本10个国家为例

2013年党的十八届三中全会提出要建立国家公园体制,国家公园立法问题逐渐提上日程.本文基于美国、加拿大、俄罗斯、英国、澳大利亚、韩国、日本等十个国家公园立法成功经验的比较研究,提出促进我国国家公园法律框架完善的政策建议.%In 2013,the Third Plenary Session of the 18th Central Committee of the CPC proposed to establish the National Park System and the legislation on national parks has been put on the agenda Based on a comparative study of successful experience of legislation in ten countries including the United States,Canada,Russia,Britain,Australia,South Korea,Japan,this paper puts forward the policy proposals to improve legal framework for national parks in China in respect of the legislative model,definition of property right and legislative principles.
