失独者养老法律困境及完善建议

摘要

Because of the deficiencies of the social security,family support has been the main mode of endowment.The tradition of raising children for old age still has the practical significance.As a unique group of today’s society,parents losing their only child have to face endowment challenges in terms of economic difficulties,lack of care and spiritual emptiness.It highlights the urgency of the security of endowment and is necessary for the government to be addressed from the legal perspective.However,there are fewer relevant legal provisions that have problems with the low level of effectiveness,the lack of feasibility and the inadequate of practical utility.It makes the assistance of the parents losing their only child only stay at a low level of economic compensation.Therefore ,the government needs to make a top-level design to protect their right of endowment in the system.%由于社会保障制度的不健全，家庭养老一直是中国养老的主要模式，“养儿防老”这一传统仍具有现实意义。作为当今社会的特殊群体，失独者不得不面临经济困难、无人照料和精神空虚等养老难题，这突显出养老保障的迫切性，亟待国家从法律层面予以解决。然而，相关的法律规定较少，存在着效力层次低、缺乏可行性和实际效用不足的问题，这使得对失独者的扶助只停留在低水平的经济补助。因此，国家需要在制度上做出顶层设计，保障失独者的养老权利。
