农村宅基地有偿退出机制的立法探讨

摘要

农村宅基地制度是直接关系到数亿农民生存和农村社会稳定的基本制度。但在实践中，农村宅基地使用权制度的运行却不尽如人意，出现了宅基地面积超标、住宅闲置现象普遍、宅基地隐形交易等一系列问题。法律法规的不完善是造成农村宅基地无序使用的主要原因，有法不依和执法不严则加剧了这种无序，而农村宅基地有偿退出机制的缺失则使这种无序找不到疏导的出口。建立激励机制和约束机制为核心的农村宅基地有偿退出机制是解决当前中国农村宅基地利用中存在问题的有效途径。%　　The rural homestead system is directly related to the basic system of hundreds of millions of farmers' survival and social stability in rural areas.
