论软法视野下的主体功能区规划创制与实施

摘要

主体功能区规划是我国第一部全国空间开发规划，旨在克服过去国土开发的无序、无度和盲目状态。主体功能区规划属于软法范畴，有创制方式与制度安排的富有弹性、实施方式的非国家强制性、创制和实施更高程度的协商民主性、效力实现的非司法中心主义四个特征。相应地，可用规划裁量基准形成、协商民主、利益补偿、绩效评价和政绩考核四项软法机制全力保障主体功能区规划的创制和实施。%The main functional region planning is the first national spatial development planning in China,which aims to over⁃come the disorder,reckless defects and blindness of land development.The main functional region planning belongs to soft law category,it has four characteristics,such as high resilience of the create way and system arrangement,non-state compul⁃sory of the method of implementing,a higher degree of deliberative democracy of the create way and system arrangement,non judicial center principle of the realization of effectiveness.Accordingly,we can adopt the four soft law mechanisms of forma⁃tion of the planning discretion criterion,deliberative democracy,benefits compensation,performance evaluation and politi⁃cal achievements assessment to fully guarantee the establishment and implementation of main functional region planning.
