公民财产权让渡理论：分析与诠释

摘要

在关于国家起源的诸多理论中，“社会契约论”对公民财产权的让渡有一定的理论解释力。根据社会契约理论，个人为了保障和维护那些在契约中得到公认的（包括财产权在内）的权利而建立了国家；公民财产权需要国家来作保护人，而国家需要公民让渡的财产来维持运转。该理论有助于国家和公民正确认识、行使和履行各自的权利和义务。%Among many theories on State origin ,“social contact theory” has certain theory explanation on citizens′prop-erty rights demisability .According to social contact theory , the state was founded for safeguarding and maintaining indi-vidual recognized rights including property rights in contract .Citizens′property rights need to be safeguarded by the state as guardian , while the state needs citizens demisable properties to run it .The theory helps countries and citizens to cor-rectly understand、 exercise and perform their respective rights and obligations .
