控制性详细规划的法制化与制定的逻辑

摘要

This paper reviews the origin and development of the regulatory detailed planning in China. It redefines the function of statutory planning based on the essence of law and four “I” features of urban development. The logic of zoning making also reveals the essence of legislation of planning.It argues that it is necessary to constitute China's statutory planning system under current political and social environment.%回顾控规的起源与发展概况,从法的实质与城市发展四个"I"的特征重新认识法定规划的作用.美国区划制定的内在逻辑揭示了规划法制化的基本依据.我国控制性详细规划处于法定规划体系中,其法制化的矛盾既源自法定规划体系的关系,又源于规划自身制定的过程.文章认为,回归法的本质与城市发展的实质,结合中国的社会政治环境探索我国法定规划体系是当前迫切的任务之一.
