To that end, it extensively explains and discusses the relevant international and regional fundamental rights instruments, the organisation of criminal justice and the system of criminal procedure in the Netherlands, the position of human rights in Dutch criminal procedure, and the most important changes within criminal procedure that might affect the realization of human rights in the Netherlands. It is stipulated that the Dutch criminal procedure system shows genuine concern for human rights. Where fundamental rights are insufficiently provided for in domestic law this is in general adequately counterbalanced by applying international human rights standards. The case law of the European Court of Human Rights in particular exerts a profound influence in this regard. Netherlands has currently signed and ratified a series of international and European regional conventions which are concentrating on the human rights protection. As to the domestic law, the Constitution and the criminal Procedure law as well as others have also involved the human rights protection in criminal justice. The courts, Prosecution service and defence promote the human rights protection. The investigative judge counterbalances the criminal investigation phase which is commanded by the prosecution services. Comprehensively, the pre-trial phase is tempered inquisitorial in nature whereas the trial phase is a moderately accusatory and adversarial.
