我国船舶抵押权登记法律性质及审查标准分析

摘要

This paper, based on the conception of ship mortgage, specified the relationship between ship registration and the establishment of ship mortgage. This paper discussed the legal nature of ship registration accordingly and analysed the present review standard of ship registration and the associated problems existed. A new review standard is proposed in accordance with the current legislation in China for the purpose of providing some reference for ship mortgage registration.%文中从船舶抵押权的概念入手，梳理了我国船舶抵押权登记与设立的关系以及船舶抵押权设立的程序，以此为基础对船舶抵押权登记的法律性质进行了探讨，分析了我国船舶登记机关现行的船舶抵押权登记审查标准及存在的问题，结合当前我国相关立法提出了新的船舶抵押权登记审查标准，为船舶抵押权工作提供参考。
