国家应急力量强制清污费用索赔的法律依据

摘要

Based on analysis of the existing laws and regulations of China and the judicatory judgment in the recent years, the paper studies whether the maritime administration is entitled to claim compensation for the expenses and costs for mandatory pollution clean-up from the owner of the ship causing the incident, referring to the practice and experience of other countries and international organizations.%文中通过分析我国现行法律中的相关规定，结合近年来司法审判实践中的具体情况，并借鉴其他国家、国际组织的做法和经验，对海事主管机关是否有权向肇事船东索赔强制清污费用的问题进行研究和探讨。
