The ease of duplication in the Internet age makes copyright infringement possible.Copyright owners tend to ask the Internet service providers (ISP)to assume responsibility.Under Article 36 of Tort Liability Law in China,ISP should also bear joint responsibility with the network users' direct infringement.However,it is not suitable to request them to take liability, whether from the existing legislative provisions,network neutrality or from the perspective of incentive theory.In fact,too heavy responsibility burden is likely to hinder the development of the network industry.ISP,the communicator and guardian of the net-work space,can act as the similar role as security guard in the network social life field.This lays the foundation for the Internet service provider to take the corresponding supplementary liability.%网络时代的易复制性使著作权备受侵犯,著作权人多在实践中寻求网络服务提供者承担责任。我国《侵权责任法》第36条对“不作为的网络服务提供者和网络用户直接侵权”规定承担连带责任。无论从现有立法规定、网络中立还是从激励理论角度探讨,网络服务提供者都不适宜承担连带责任。事实上,过重的责任负担容易阻碍网络产业的发展。网络服务提供者是网络空间的传播者和守护者,其在职责范围内对网络社会生活场域充当着类似安全保护角色。这为网络服务提供者承担相应的补充责任奠定了基础和提供了可行的路径。
