当代中国法治秩序的构建与现实策略

摘要

Under the gradual transformation strategy,China's reform and opening up has promoted the development of market e-conomy,and a dual structure between the state and the society formed initially.To develop the market economy and promote de-mocracy,the Communist Party of China put forward the “rule of law”strategy.However,the construction of the rule of law to-day has fallen into deep dilemma and order crisis due to the selection and positioning of the path of “nationalism”law,the loss of “folk governance”as well as the lack of legal community foundation.Fortunately,the rise of the governance theory and NGO's mission and responsibility in “folk governance”provide a new thinking and perspective for it as well as for the order generation mechanism.In conclusion,China should take the independent road on its way to build a state with an adequate legal system.%中国的改革开放在渐进式的转型策略下，逐步推动了市场经济的发展，初步实现了国家与社会二元架构的形成。基于发展市场经济和推动民主政治的需要，中国共产党提出了“依法治国”方略。但由于“国家主义”法治路径的选择与定位以及“民间治理”的缺位与法治社会根基的缺失，使当代中国的法治建设陷入了深层的困境与秩序危机之中。然而，治理理论的兴起以及非政府组织在“民间治理”中的使命与担当则为当代中国的法治建设与秩序生成机制提供了一个新的思路与视角。为此，当代中国必须走“自主化”发展的“法治中国”之路。
