Schools from state to state deal with the issues of student misconduct and discipline. These issues often lead to instances of litigation. This trend is rapidly increasing and challenging for school administrators. It is important for educators to be knowledgeable of issues and trends involving student misconduct and discipline, in order to avoid unnecessary litigation.;The purpose of this study was to examine litigation issues involving student misconduct and discipline in schools. This research highlights various aspects involving student misconduct and discipline in educational settings. This study provides insight into legal issues, outcomes, trends, and guidelines to increase knowledge and possibly prevent potential litigation.;The research design of this study consisted of qualitative, descriptive, historical-based document analysis. Court case documents were analyzed between the time period from 1982 to 2011. Cases were identified using West's Law Education Digest Keynumber Schools 169, control of pupils and discipline in general. Cases were briefed by outlining the following: citations, key facts, issue, holdings, reasoning, and disposition. Production of data focused on case background, court outcomes, and supportive reasoning of decisions. Research focused on litigation in the area of student misconduct and discipline, offering educational administrators insightful information to assist in carrying out the daily responsibilities involving student misconduct and discipline.
