从模因论的视角下研究英文版《与贸易有关的知识产权协定》及其汉译

摘要

模因论是英国生物学家道金斯在新达尔文进化论基础上提出关于文化进化的研究理论。他指出在文化的发展变化过程中，具有同基因类似的复制因子使文化能够传播、传承、延续和发展，这种复制因子就是模因。此后，许多学者从模因的视角着重对文化发展中最重要的语言现象进行研究，语言模因和翻译模因随之产生。
　　在此基础上，本文以立法文本《与贸易有关的知识产权协定》为例进行描述性分析，探讨如何识别法律模因，如何翻译《与贸易有关的知识产权协定》，如何对法律模因进行适当的翻译使之成为一种规范。此外，本文对模因的相关概念、模因的复制和传播方式、模因的生命周期、模因的选择标准和如何从模因变成规范都有详细的说明，目的在于通过本文从模因的角度对《与贸易有关的知识产权协定》的分析,我们能从一个新的角度对法律翻译有更清楚更全面的认识和理解,并能在翻译过程中识别相应的法律模因,并利用模因自我规范的功能选择合适的翻译手段。
