基于认知参照点模型的汉语立法文本中的零形回指及其识解研究

摘要

零形回指是现代汉语中非常普遍的一种语言现象，被认为是汉语回指的标准模式。目前，针对这一语言现象的研究已经取得了丰硕的成果。然而，以往的研究大多集中在英、汉叙事语篇等文艺语体上，甚少有学者涉足法律语体中的零形回指。鉴于此，在前人研究的基础之上，基于认知参照点模型这一理论，以《中华人民共和国行政许可法》（以下简称《行政许可法》）为语料来源，采用定量与定性相结合的研究方法，本文探究了所选立法文本中零形回指的表征形式以及零形回指回指语的识解机制。本文有以下三方面的发现： 第一，《行政许可法》中的零形回指主要可以分为三类：零形上指（话题凸显）、零形下指和特殊零形回指（话题隐含）。其中，零形上指（话题凸显）出现的频率最高，在所选文本中占有较大的比重，因此成为本文重点研究的内容。 第二，零形回指在《行政许可法》中主要具有以下三方面的功能： （1）增强立法语篇的连贯性； （2）保证立法语言的经济性； （3）强调立法信息的焦点性。 第三，基于认知参照点模型，本文提出了汉语立法文本中零形回指的识解机制。该识解机制对零形回指的回指语的识解具有强大的解释力。此外，本文还探讨了该识解机制对汉语规范性立法文本的翻译以及对汉语法律语篇的分析所具有的重要意义。 本研究一方面是对传统回指研究的一种补充与发展，另一方面对汉语立法文本的翻译也带来了一定的启示。
