EIA is a widely recognised as a useful tool for planning an activity, as well as a systematic review of possible impacts of that activity and how to avoid the significant adverse impacts. In international environmental law, transboundary issues related to environmental impact assessment are treated in several contexts, such as the UN/ECE Convention on Environmental Impact Assessment in a Trans-boundary Context (the Espoo Convention) and the EU directives 85/337 (on environmental assessment of projects) and 2001/42 (on environmental assessment of certain plans and programmes), as well as in the guidelines of the European development bank (EBRD) and the World Bank. The Espoo Convention: The Convention on Environmental Impact Assessment (EIA) in a Trans-boundary Context stipulates the obligations of Parties to assess the environmental impact of certain activities at an early stage of planning an activity. It also lays down the general obligation of States to notify and consult each other on all major projects under consideration that are likely to have a significant adverse environmental impact across national boundaries.
