OP09: Analysis of training and learning in legal decision making applied to EU trade mark opposition cases (2EW0060)

In an effort to harmonise the outcomes of its trade mark legal decision making processes, the Office for Harmonization in the Internal Market (OHIM) has launched the OP09 best-practice project to better train and execute these processes when applied to opposition cases. At the same time, the project is used as a test environment to gain a better understanding of the mechanisms of the decision making process, its learning from the newcomer perspective and the difficulties to training and execution induced by cases or procedural constellations. Starting with practically-minded explanations of the process environment and of the project setup, the goal of this paper is to develop out of these a first methodological approach for opposition analysis, addressing both operational and analytical aspects.
