The Execution by BankTransfer of the Obligation to Pay an Amount of Money, According to the Civil Code. Specific Aspects

The payment is the remittance of an amount of money or, where applicable, any provision of services which would represent the very object of the obligation, according to the law. We shall subject to our analysis the voluntary execution by bank transfer of the obligation to pay an amount of money, under the aspect of the notion, subjects and conditions. We shall try its particularization, also aiming an interdisciplinary analysis, as regards other financial obligations, mainly with a banking nature. Our study is focused on the analysis of the special norms allocated to this obligation by the Romanian Civil Code, by attempting a critical exam of these, in the light of the special law, as well as of the specialized doctrinal papers.
