To oppose summary judgment in color discrimination case, Etienne offered the affidavit of a former manager (Johnson) that stated Terradot (decision-maker) assigned. responsibilities to employees by skin color, that Terredot "would not let a dark skinned black person handle any money," and that Terrodot and his wife on several occasions told Johnson they thought Etienne was "too black" to do various tasks at the casino. District court granted summary judgment based in part on the fact that most of the managers at the casino were black and comments were not direct evidence of discriminatory animus.
