The Canadian Federal Government enacted Bill C - 45 on March 31, 2004 that amends the Canadian Criminal Code and provides for the criminalization of health and safety shortcomings. Officers and representatives of organizations are required to practice due diligence and take all reasonable steps to protect the worker and the public. This paper briefly summarizes the history leading up to this historic, breakthrough legislation and advocates the imperative of employing a managed system approach to health and safety.
