With all of the focus on the Clean Air Act Amendments and EPA's authorities to implement various rules, little attention has been given to the needs of the plant manager. "Flexible permitting"is a method by which plant managers can obtain what they need to protect operational flexibility and has evolved to become a negotiating mechanism to customize permit terms. This article discusses the building blocks for flexible permits and provides a description of the major examples and policy documents that supported the development of flexible permits. EPA has cited some of these examples in its policies and proposals addressing operating permits and New Source Review. This article provides the important aspects of those examples and others to show the available options for each building block.
