The method involves determining transmitting power necessary for data communication before transmission of data by a transmission unit. The determined transmitting power is compared with a given maximally permissible transmitting power. The data communication is delayed if the determined transmitting power is larger than the maximally permissible transmitting power, where the maximally permissible transmitting power is set on the basis of variable parameters. An independent claim is also included for a mobile data communication device.
