The invention discloses an oil temperature presumption device for presuming work oil of vehicle and an oil temperature presumption method. The oil temperature presumption device comprises an oil temperature sensor for outputting an output value corresponding to the oil temperature of the work oil of the vehicle, a filter processing mechanism subjected to a first filter processing so that the change of the output value isdelayed in a specified response, a filter switch mechanism for comparing the output value with a specified threshold and switching the processing of the filter processing mechanism into a second filter processing which is more delayed than the first filter processing when the oil temperature corresponding to the output value is above the specified threshold value, and an oil temperature presumption mechanism for presuming oil temperature of the work oil according to the output value obtained through the first or second filter processing.
