PURPOSE: An apparatus for protecting software copyright through watermarks and a method thereof are provided to achieve code size increase and execution time increase overhead less than 10 % and to prevent damage when a program code is changed through automated tools including robustness, desultory reading and optimization. CONSTITUTION: A calculation part calculates marking data from the number of commands included in the software. A marking part performs watermarking of the calculated marking data in the software.
