Disclosed are a vehicle weight measuring device, a method thereof, and an overloading and capacity-exceeding prevention method using the same. The vehicle weight measuring device includes: a vehicle driving data receiving unit which receives vehicle driving data from at least one among an electronic control unit or a GPS unit when a vehicle drives a standard distance; a database which stores at least one among a relational formula or a relational table between the amount of energy necessary for the vehicle to drive the standard distance and the weight of the vehicle; and a calculation unit which calculates the consumed amount of energy by the vehicle to drive the standard distance based on the vehicle driving data and estimates the weight of the vehicle as the weight corresponding to the calculated consumed amount of energy using at least one among the relational formula or the relational table stored in the database. By doing so, the device is able to measure the weight of the vehicle using vehicle driving-related data accurately.
