The present invention relates to an apparatus and a method for adjusting a variable code length in visible light communication based on a light emitting diode. The apparatus for adjusting a variable code length according to an embodiment includes: a calculating unit for calculating a spreading diversity gain and an inter-code interference based on overlapped field of view (FOV) information of lightings; a comparing unit for comparing sizes between the calculated spreading diversity gain with the calculated inter-code interference; and a variable code length adjusting unit for variably adjusting a code length after considering the comparison result for the size. Therefore, inter-channel interference is reduced by adjusting the variable code length, so that the performance of the system is improved, and as a result, quality of service (QoS) is satisfied.
