The present dissertation analyzes validity of Resolution 008 enacted by the Regulatory Board of the Market Power Control and Regulation Act. It assesses in particular the provisions regarding private labels (Article 6 and 9). Pursuant to those provisions; supermarkets are obliged to subscribe independent contracts with their suppliers of products sold with private labeling. This dissertation will discuss why, in so doing, the Regulatory Board has surpassed the scope of its attributions by breaching the principle of legality, the principle of freedom of contract, enterprise and the Constitution.
