Security Analysis Matters Where Alcohol Is Commercially Sold: Expert Opinions and the Relevance of Security Practices in the Alcohol Service Industry

This article considers the role of security analysis mainly in civil litigations involving the sale, service, or provision of alcoholic beverages in commercial venues, eg bars, dance halls, gentlemen's clubs, and similar places. Security experts may be retained to evaluate facts and evidence when it is alleged that unlawful service of alcohol resulted in intoxication and a subsequent death or injury from a criminal attack or automobile accident. This article summarizes approaches taken by security experts for litigation which undertakes investigation of how a customer was permitted to reach or exceed the legal level of intoxication (ie 0.08-0.10 grams/deciliter (g/dl) depending on the jurisdiction). It also discusses areas of weak or non-existent security practices which give rise to a plaintiff's allegations of negligent conduct in selling or serving alcohol, suggesting that aggressive and consistent implementation of key prevention strategies may reduce exposure to litigation.
