With the threat of penalties of up to $1 million a day per violation, companies subject to the Reliability Standards of the North American Electric Reliability Corporation (NERC) must not only thoroughly understand the requirements of applicable standards, but also must have controls in place to minimize the risk of noncompliance, and, should a violation nevertheless occur, be in a position to minimize penalties. It is essential that company compliance personnel understand the evidentiary standards that NERC will apply in evaluating compliance and ensure that the company's compliance program meets these standards.
