The Patient Protection and Affordable Care Act (PPACA) amends the Fair Labor Standards Act (FSLA Section 18B) and requires employers subject to FSLA to provide a written notice regarding the new Health Insurance Marketplace (previously called the Exchange) to all current employees (regardless of part-time or full-time status) by October 1, 2013. For employees hired after October 1, 2013, the information must be provided at time of hire. While initially effective March 1, 2013, the Department of Labor(DOL) delayed this notification requirement until after guidance is issued. The DOL recently released Technical Release 2013-02, containing temporary guidance and model notices.
