In May 2009, the American Civil Liberties Union (ACLU) and the nonprofit Public Patent Foundation filed a lawsuit alleging that patents on the BRCA1 and BRCA2 genes are unconstitutional and invalid.The suit was filed on behalf of a variety of plaintiffs in New York federal court against the US Patent and Trademark Office (PTO), Myriad Genetics, and the University of Utah Research Foundation, which is the patent holder of the genes.
