Dispute Resolution-Third-Party Funding: Helping Companies Control Runaway Litigation Costs

In this comment I look at litigation finance and offer a sound strategy to reduce legal department expenses. I argue that, no matter how clever and demanding the toughest general counsel is in negotiating lower fees from outside counsel, it is not enough. General counsel are under pressure because they have a fundamental problem: businesses do not want to divert their capital or draw on credit to cover the cost of litigation. Corporate assets sometimes can only be recovered through litigation. Litigation is expensive. And so it goes.
