The Bureau of Land Management (BLM) cancelled oil and gas leases covering acquired lands that it had issued to Liberty Southern Partners, LLC (Liberty) after BLM discovered that the surface management agency, the U.S. Forest Service (Forest Service), did not consent to the leases. In Liberty Southern Partners, LLC, 183 IBLA 383, GFS(0&G) 5(2013), the Interior Board of Land Appeals (IBLA) affirmed BLM's cancellation, holding that BLM must obtain consent from the surface management agency before issuing a lease on acquired lands and that BLM has the authority to cancel any lease that was improperly issued without such consent.
