摘要：通过对国内油田企业的调研，收集了油田ERP模块用户管理与应用需求信息，基于商务智能应用原理与技术特点，引用先进的商务智能技术与模型，结合国内油田KPI指标考核与展示需求，运用数据仓库与挖掘技术，探索、研究、提取、过滤ERP系统的数据信息，构建一套基于BI技术的油田决策支持系统和管理平台，为油田管理层、决策层提供及时、准确的生产经营决策支持管理做出有价值的探索。%Through some research work about domestic oilfield enterprises,we collected information of user management and application requirements in oilfield ERP modules. Based on the advanced business intelligence technology and model, we studied,extracted and filtered the data information in ERP system by means of data warehouse and mining technology to meet the KPI assessment and display requirements in oilfield enterprises in China. Then we built a decision support system and management platform based on BI technology,which makes a valuable exploration in timely and accurate decision-support management for management and policy makers in oilfield enterprises.
摘要：With the rapid development of network information technology and the various forms of political participation, such as e-government,network public opinion,network voting,network political forum and advice-seeking from netizens on microblogs,the duality of network political participation has become increasingly prominent. It is mainly manifested in the coexistence of openness with bigotry,convenience with operability,virtuality with randomness,decentralization with control difficulty,and equality with inequality. Meanwhile,the duality of political participation has brought double effects on the de-velopment of China’s political culture. On the one hand,network political participation can cultivate a rational and moderate political attitude,thus help to promote socialization of political culture in China,bringing it into one with more civic participa-tion. On the other hand,irrational political participation hinders the formation of network political culture,and infiltration of the strong political culture impedes the development of mainstream political culture. Therefore,the author suggests a path to positive development of both network political participation and political culture.%随着网络信息技术的快速发展，网民通过电子政务、网络舆论、网络投票、网络政治性论坛、政治博客、微博问政等形式进行政治参与活动，网络政治参与的两重性日益凸显，主要表现为：开放性与盲从性、便捷性与可操作性、虚拟性与随意性、非中心化与难控性、平等性与不平等性并存。这给我国政治文化的发展带来了双重效应：一方面，网络政治参与能够培养网民理性的政治态度，从而推动我国政治社会化进程，推动政治文化向参与型和公民文化转变；另一方面，非理性的政治参与阻碍了网络政治文化的形成，强势政治文化的渗透冲击主流政治文化的发展。在此基础上，提出了网络政治参与和政治文化良性发展的路径选择。
摘要：对于单位犯罪，早在97刑法就已规定在其总则之中，但与之配套实施的程序法刑事诉讼法到目前为止却仍未有相关的详尽规定。如何建立一套与单位犯罪的实体法相对应的程序法制度就显得尤为重要。结合当下的各种学说，构建一套“被告单位诉讼参与人”制度，用来规范被告单位参与刑事诉讼活动的程序、权利和义务，使其得到公正审判，进而维护司法公正，可行且必要。%Unit crime has been stipulated in the general provisions by 1997 criminal law,but there still lack relevant detailed rules about the procedure law and criminal litigation supporting the implementation so far. Therefore,it is particularly important to establish a set of procedural law system corresponding to substantive law of unit crime. Based on various theories,we think it is feasible and essential to introduce a set of“defendant unit participants in proceedings”system to regulate procedure,rights and obligations of the defendant units involved in criminal litigation,so that the units get fair trail,thus safeguarding judicial justice.
摘要：At the time of the British Parliament reform in 1867,representative government set up in Mill’s book was no longer a Utopia,but a practical blueprint in politics about power distribution. In order to compete for the parliament’s power with feudal aristocracy,the bourgeoisie had to hold the banner of democracy,to endow themselves the legitimacy of their conducts and to guide and pave way for the reform. Therefore,the revival of democracy and explanation in accordance with reality are urgently needed. Meanwhile,from the perspective of their class interest,liberal thought and the realistic environment, the bourgeoisie had to place necessary restrictions,to the democracy at the same time,so as to guarantee its smooth and stable running. Therefore,the underlying logic of Mill’s representative government is the thought of democratic revival and restriction.%时值英国的议会改革，密尔的《代议制政府》不是空想的乌托邦，而是他设计的政治蓝图和一个权力分配的方案。为了同封建贵族争夺议会的权力，资产阶级必须扛起民主的大旗，以赋予其行为的正当性，为政府的改革提供依据和方向。因此，要复兴民主，并做出适合现实的阐释。但是，由于其阶级利益的要求，以及自由主义思想的主张和现实环境的考虑，复兴民主的同时又要对民主进行必要的限制，以保证民主安全的运行。所以，密尔主张的代议制政府背后的逻辑是民主的复兴与限制的思想。
摘要：In the process of oilfield development,the water cut of crude oil increase continuously at the middle or late stage of development. It would,on the one hand,lead to the decline of production,and on the other hand,result in the increase in investment in oil recovery enhancement. Therefore,economic benefits of different oilfields differ widely,and it is very important to evaluate the benefit of the oilfield with efficiency and preciseness. With cluster analysis of grey system theory, and combined with the actual situation of oilfield development,we picked seven representative factors to do the grey clustering analysis and research,which include:single well verified daily oil output,single well verified daily fluid production,average water cut,geological mining speed,well working rate,effective rate for old well measures and unit production cost in six blocks of SL oilfield. The evaluation results may provide a new method for oilfield economic benefit evaluation..%随着油田开发的深入，进入中后期开发的油田由于综合含水量增加，会导致油气产量递减，增产措施费用增加，不同油田的经济效益也就有所不同，因此有效准确地评价油田经济效益十分重要。本文运用灰色系统理论的聚类分析方法，结合某油田开发的实际情况，以某油田作业区的6个区块为例，选取单井核实日产油、单井核实日产液、综合含水、地质开采速度、开井率、老井措施有效率和单位生产成本7个代表性因素进行灰色聚类分析和研究，得到6个区块的评价结果，为评价油田经济效益提供了一种方法。
摘要：With the prevalence of“playing mahjong”,many scholars have expressed their concerns and advised that the government should take due measures to stop the“Mahjong Trend”from causing negative impacts. Through questionnaire surveys on mahjong players in Nanchong city,the author analyzed the data collected with SPSS 15.0. The results show that“Playing mahjong”is prevailing because most citizens are apt to regard it as a form of pastime;“playing mahjong”doesn’t have as bad effects on the citizens’life as some scholars have worried;the vast majority of citizens can make the right choice between“playing mahjong”and living the normal life. Therefore we can come to the conclusion that it is not necessary to put“playing mahjong”under full government governance. The government should not interfere in people’s playing mahjong unless they commit mahjong gambling.%“搓麻”现象在我国随处可见，随着这一现象的兴起，很多学者都对此提出了顾虑，认为“麻将风”必须引起政府的高度重视，否则后果将不堪设想。本文以四川省南充市为例，以“搓麻”行为者为研究对象，通过问卷调查方式，并对采集数据利用SPSS15.0进行统计分析，结果发现：（1）“搓麻”行为普遍存在，缘于公民更多地将其定义为一种娱乐方式，将麻将作为消遣时间的一种工具；（2）“搓麻”行为对公民生活的影响并没有某些学者所指出的那般恶劣；（3）绝大部分公民能够理性地在“搓麻”行为与正常生活间做出选择。由此得出结论：“搓麻”行为大众化不是一个性质恶劣的社会问题，不应完全纳入政府治理的范畴。政府对“搓麻”行为的治理，除非民众将“搓麻”行为作为赌博方式，触犯了如“赌博罪”等刑法罪名，否则政府不宜加以干涉。

Network sovereignty is a subordinate concept of national sovereignty,with obvious relativity and internationality. Network sovereignty is the latest development and an important part of the national sovereignty. The effective exercise and maintaining of national sovereignty is inseparable from the network sovereignty. So the network sovereignty and national sovereignty are complementary and mutually supportive.
摘要：The characteristics of abstractness and ambiguity of public interest make it difficult to define the concept of public interest,and scholars differ in their opinions. Therefore,it is necessary to establish the criteria for public interest recognition as it is the core of economic law. In economic law theory,the fundamental position of public interest is first ensured by distinguishing it from other related interests. Then,recognition and definition of public interest are further strengthened through the substantive standards like value judgment and categorization,and the procedure standards such as prior review and the judicial relief mechanism. Thus the legitimacy and validity of the public interests in economic law is ensured.%由于公共利益本身的模糊性和不确定性等特征，使得公共利益成为一个难以界定的概念，学者们各有分歧。但基于公共利益对于经济法的特殊性，需要对经济法上公共利益的识别标准进行探讨。在经济法理论中，需通过区别经济法上的公共利益与其他相关利益，把握公共利益在经济法中的基础地位，再从价值判断、“类型化”方式等实质标准和事前审查、事后司法救济机制等程序标准进一步加强对公共利益的识别和界定，保障经济法中公共利益的正当性与合法性。
摘要：NDRC requires that the ladder price system of gas for domestic use should be established in all the cities that have been equipped with gas pipeline by the end of 2015. This is of great significance in advocating thrift in gas use,alleviating the pressure of gas supply and in promoting fair distribution of social resources and the sustainable and stable development of gas companies. Appropriate measurement cycle must be selected and reasonable ladder gas volume should be settled. This paper maintains that the most appropriate measurement cycle for ladder gas volume is a quarter and the first leg volume should be set between 150 cubic meters and 180 cubic meters. Scientific and reasonable ladder price of gas for domestic use should be set on the principle of giving full play to the decisive role that market plays in the allocation of resources and better play of government’s role.%国家发改委要求在2015年底以前所有已通气城市均应建立起居民生活用气阶梯价格制度。这对于引导居民节约用气，缓解供气紧张压力，促进社会资源公平分配和燃气公司持续稳定发展，都具有重大意义。建立阶梯气价制度，必须选择适当的计量周期，确定合理的阶梯气量。本文认为，以1个季度作为阶梯气量计量周期最为合适，第一档气量应定在150 m3～180 m3之间，按照充分发挥市场在资源配置中起决定性作用和更好发挥政府作用的原则，制定科学合理的居民生活用气阶梯价格。
摘要：According to the Law of the people’s Republic of China on Application of Laws to Foreign-related Civil Relations, when referring to the law application of foreign-related chattels,a priority should be given to the autonomy of will of the party’s and then apply the law with the principle of“lex loci rei sitae”. It becomes a trend in obligation of real right that the principle of autonomy of will of the party’s in the law of obligation has been introduced into real right realm. However,this inevitably gives an unfavorable impact on the traditional property jurisprudence,which may result in less guaranteed security in international commercial trade. Nowadays,most countries have adopted the principle of“lex loci rei sitae”as for as chattels and realties are concerned,and the principle of“mobilia sequuntur personam”of personal law is being given a minor position by those nations. Yet,application of laws to foreign-related chattels is more complex than that to realty issues,and it may causes collision in applying the conflict law due to the complex structure of chattels and the uncertainties of the location of realties. Thus,many countries have defined some exceptional circumstances.%我国《涉外民事关系法律适用法》规定，对于涉外动产物权的法律适用问题，以当事人的意思自治为优先原则，再依照“物之所在地法”的原则进行法律适用。将债法的意思自治原则引入物权领域的规定融合了物权债权化的发展趋势，但是也冲击了传统的物权的法理领域，可能不利于国际商事交往中的交易安全。纵观世界，现在大部分国家对动产和不动产统一适用“物之所在地法”原则，“动产随人”的“属人法”原则逐渐在各国的立法中淡化。但是，涉外动产的法律适用问题要远远比不动产复杂，在适用法律的实践过程中又会因为动产的构成因素复杂性与不同动产处所的不可确定性等问题在运用冲突法原则上产生问题，于是，许多国家又为此规定了例外的情形。
摘要：实践基地是高校大学生开展社会实践活动的载体，利益相关者理论为社会实践基地建设提供了一个分析方法。本文以利益相关者理论为视角，对当前我国大学生社会实践基地建设进行研究，分析指出高校大学生社会实践基地利益相关者有核心利益相关者、重要利益相关者、间接利益相关者和边缘利益相关者四种，阐释了利益相关者理论在高校大学生实践基地中的制度建设、内部管理、共同治理和教育质量及评价方面起着重要的作用，并为实践基地提供了建设思路。%Practice bases are where college students carry out social practices. Stakeholder theory provides an analysis method to the construction of social practice bases. Based on stakeholder theory,the author made studies on the construction of college students’social practice bases,which reveals that there are four kinds of stakeholders: core stakeholder,major stakeholder, indirect stakeholder,and marginal stakeholder. In addition,this paper explains the important function of stakeholder theory in the construction of practice bases in system construction,internal management,cooperative governance,and in education quality and evaluation. It is hoped that the study can provide a framework for practice base construction.
摘要：Housing provident fund took the lead in the reform of the housing distribution system. However,with the further development of social economy,the existing housing provident fund system doesn’t apply to the present situation. After the end of two sessions on 13th March 2014,people in mounting numbers voice growing concern over the controversial system:the phenomenon of“rob the poor and assist the rich”. This paper analyzes the causes of the phenomenon,explores the development path of housing fund,and presents the following ways to improve China’s provident fund system: resetting the contribution rate and enlarge the coverage of housing provident fund,optimizing investment of the fund in a multi-channel portfolio,and utilizing reasonably the added value of the fund. We hope all these ways would meet the needs of urbanization and make housing provident fund beneficial to citizen.%住房公积金制度在我国住房分配制度的改革上起到了引导作用，但是，随着社会经济进一步发展，现有的住房公积金管理制度已经明显不适应目前形势的发展。2014年3月13日全国“两会”闭幕后，原本饱受争议的住房公积金制度再次引发公众的探讨，越来越多的公众质疑住房公积金的劫“贫”济“富”现象。通过深层次分析住房公积金制度劫“贫”济“富”的缘由，探索我国住房公积金的发展路径，提出确定合理的缴费率、扩大住房公积金的覆盖范围和多渠道实现公积金投资、合理利用住房公积金的增值收益等手段来完善我国的公积金制度，使其更加适应城镇化发展的要求，让住房公积金普惠于民。
摘要：As a means of payment in prepaid consumption,commercial prepaid cards have stimulated consumption and pro-moted economic development. However,there also present various defects. Therefore,the Chinese government has launched a series of rules and regulations to supervise the use of commercial prepaid cards. Researches on the regulations of commercial prepaid card are flourishing. Public power is necessary for beforehand regulation of commercial prepaid card,and private right for post relief of commercial prepaid card is indispensable as well. At present,the regulation of commercial prepaid card in China is mainly manifested in the supervision of public law enforcement. In terms of private laws,only general rules of Con-tract Law and Law on Protection of the Rights and Interests of Consumers are used to maintain the supervision of commercial prepaid card. Given this,it is necessary to analyze the debtor-creditor relationship,the protection of consumers’ rights and interests and the establishment of the commercial prepaid card contract from the perspective of private law to strengthen the post relief of commercial prepaid card.%作为预付式消费载体的商业预付卡，其持续发展在刺激消费并促进经济发展的同时所体现出来的弊病不在少数，为此我国政府出台了一系列规章制度来对其进行监管，学界对商业预付卡的规制研究更是百花齐放。公权力对商业预付卡的事前规制必不可少，私权利对商业预付卡的事后救济也不可或缺。而现今我国对于商业预付卡的规制多体现于公法的强制监督，私法方面则仅靠《合同法》、《消费者权益保护法》的一般性规定来维护。鉴于此，有必要从私法角度对债权债务关系、消费者各项权益的保护、商业预付卡合同的建立进行借鉴分析，加强对商业预付卡的事后救济。
