The court in SWEPI, L.P. v. Camden Resources, Inc., 139 S.W.3d 332 (Tex. App.--San Antonio 2004, pet. filed), reversed a summary judgment against the plaintiffs, SWEPI, L.P., KLT, Inc., and KLT Gas, Inc. (collectively KLT), the owners of an oil and gas lease adjacent to the land on which the defendant operator, Camden, had drilled its Casas Well No. 1. Believing the Casas well's bottom hole location was beneath its own tract or impermissibly close to the lease boundary, SWEPI filed a complaint with the Texas Railroad Commission, requesting that the Casas well be shut in and a directional survey be ordered to determine whether the well was in compliance with spacing rules. SWEPI and KLT also sued Camden, alleging subsurface trespass and conversion of gas.
