The U.S.Supreme Court on Dec.8 heard oral arguments over the constitutionality of the beef producers' check-off program in an appeal of a ruling by the U.S.Court of Appeals for the Eighth Circuit that found the program in violation of the First Amendment.The high court is expected to hand down its ruling during the first six months of this year.ff the court rules against the program,numerous other check-off programs,including the propane industry assessment administered by the Propane Education and Research Council,could be opened to constitutional challenges.
