Canadian Regulators Issue Reasons For Rejecting TransCanada’s Pleading for Variances from the Mainline Toll Restructuring Decision Issued in March

The National Energy Board of Canada (NEB), on 7/22/13, issued its letter that provides the reasons for the Board’s decision in June to dismiss the TransCanada PipeLines Ltd. review and variance petition, filed May 1, after a decision was made on a restructuring of services on TransCanada’s Mainline pipeline system and fixing tolls (rates) on that system (Restructuring Application). Among other claims in TransCanada’s petition was the assertion that the NEB did not treat TransCanada fairly in the proceeding that led to the RH-003-2011 Decision. TransCanada asserts that the Board “breached the duty to be fair” because TransCanada wasn’t given the opportunity to submit additional evidence on how the findings made in the Decision would affect TransCanada.
