NOT ALL INTERVENERS WERE SATISFIED WITH DOMAC/GDF SUEZ'S RESPONSE TO THEIR CONCERNS REGARDING AN IMPENDING RESTRUCTURING AND TEMPORARY WAIVERS OF CAPACITY RELEASE REGULATIONS; FERC GRANTS WAIVERS ANYWAY

Distrigas of Massachusetts LLC (DOMAC) and GDF SUEZ Gas NA LLC (GSGNA) (RP11-1871), in support of their pending joint petition for temporary waiver of FERC's capacity releases regulations and policies filed 3/2/11, told the Commission that since that filing the parties have undertaken several discussions to address the issues raised in this proceeding. According to DOMAC, Algonquin and the petitioners reached consensus regarding the scope of the waiver of the tariff provisions requested. Petitioners however explained that they continue to engage in discussions with the other commenting interveners regarding the restructuring. DOMAC/GDF told the Commission they have provided information requested by the interveners and confirmed “their intent to provide financial information relating to DOMAC and GSGNA when such information is available.” In addition, the petitioners, in their response, reaffirmed and expanded upon their commitment to fulfill the obligations under DOMAC's current transportation and sales agreements.
