Producers Allege Western Refining Pipeline Is Pursuing Anti-Competitive Plan Governing Crude Oil Transportation in Four Corners Area of U.S.

Resolute Natural Resources Co. and Resolute Aneth, LLC (collectively, Resolute) filed a protest and motion to intervene in a proceeding regarding a 2/8/08 tariff filed by Western Refining Pipeline Co. (IS08-131) to govern transportation of crude oil by Western. According to the protesters, Western is attempting to use the tariff to secure FERC's "validation of Western's exercise of market power by illegally preferring its affiliates and discriminating against third parties such as Resolute who seek access to competitive markets for their crude oil." Western's tariff is intended solely to benefit Western and its affiliates, to the exclusion and detriment of Resolute, the Navajo Nation, and the consuming public who will be denied the benefits of increased production from the Four Corners area of the U.S.
