Marketer Complaint Alleges Discrimination and Misinterpretation Marked Open Season Bidding for Highly Unusual 90-Plus Year Contracts with Cheyenne Plains Gas Co.

On 8/29/08, G4 Energy LLC filed a complaint alleging Cheyenne Plains Gas Co., LLC1 (RP08-580) violated the Natural Gas Act, FERC regulations and Cheyenne Plains' tariff by failing to invalidate the results of an open season with a defective posting that stated a highly unusual 90-plus years term for which the capacity was being offered, and failing to hold a second open season that provided all prospective shippers an equal opportunity to bid based on a posting that more clearly detailed the terms and conditions of the unsubscribed capacity being offered. But G4 Energy interpreted the open season as ending May 31 of the last year for which capacity was offered (2099). Thus, it did not bid for September, October, November, December 2099. As a remedy, G4 Energy requested that the Commission void Cheyenne Plains' previous open season and order Cheyenne Plains to conduct a new open season.
