FERC DENIES COMPLAINT OF G4 ENERGY ALLEGING CHEYENNE PLAINS DID NOT CLEARLY SPECIFY TERMS OF OPEN SEASON IN POSTING

By order issued 12/2/08,FERC ruled that G4 Energy,LLC was wrong in its complaint allegations that Cheyenne Plains Gas Co.,LLC(RP08-560)violated Section 5 of the Natural Gas Act(NGA),the regulations,and pipeline tariffs and had published an ambiguous open season posting.The G4 Energy Group had argued that the pipeline should have held a second open season with more clearly explained terms.The Commission denied the complaint based upon its finding that the open season clearly denotes the terms and conditions for the unsubscribed capacity.
