FERC Accepts Black Box Settlement of Discovery's Rates, Including a New Hurricane and Natural Disaster Surcharge, But Severs Contesting Party ExxonMobil Gas & Power

FERC earlier this month approved a settlement and severed one party in the negotiations that will lead to revised rates that Discovery Gas Transmission LLC (RP08-70) will charge its customers. Last fall, Discovery filed a settlement agreement and associated pro forma tariff sheets to revise Discovery's base tariff rates and to substitute for a general Natural Gas Act (NGA) Section 4 rate case. ExxonMobil Gas & Power Marketing Co. protested the settlement. According to the Commission's order, dated 2/5/08, Discovery must continue to offer service to ExxonMobil under its existing rates, unless it makes a formal rate case filing proposing revised rates that would be applicable only to ExxonMobil.
