U.S. Export Control Commitments In S&ED Don't Deviate From U.S. Law

The United States committed to a number of actions in the area of export controls in last week's Strategic and Economic Dialogue (S&ED), but an administration official reiterated that these commitments fall within the policy confines of current U.S. export control law and will do nothing to change U.S. export control policy toward China. However, U.S. industry sources said it is notable that China raised export control issues at a high level forum such as the S&ED, repeating concerns that were also brought up at last November's Joint Commission on Commerce and Trade (JCCT). The S&ED is viewed as a higher level U.S.-China dialogue than the JCCT. One industry source argued that China is placing continued emphasis on U.S. export controls because it views its ability to import dual-use goods as growing in importance in coming years as its economy shifts to rely more on imports and the production of higher-value products. Other U.S. industry sources said the points raised in a U.S.-China joint statement released after the dialogue continue to be a political response to U.S. demands in other areas such as China's lax enforcement of intellectual property rights.
