The UK government is proposing amendments to national EU emissions trading scheme (ETS) legislation that would allow regulators to impose smaller, discretionary penalties when fining installations that under-reported or did not submit their verified emissions volumes before 2013. The UK’s Department of Energy and Climate Change (Decc) and Environment Agency launched a consultation in August on the amendments. Under the new rules, regulators could impose a penalty of ?20/t CO2 equivalent ($26.50/t CO2e) on UK installations that have not complied with EU ETS allowance submission requirements before this year, provided operators “voluntarily identify” their under-reporting and surrender the required allowances accordingly. This is in contrast to an existing inflexible fine of ?100/t CO2e.
